Evidence status: CURRENT IMPLEMENTING REGULATION. Nevada Administrative Code 639.838 explains how the statutory prescription medication agreement operates when treatment is provided by a group practice.

Group-practice agreement allowed

A patient may satisfy NRS §639.23914 by entering into the prescription medication agreement with a group of practitioners, including through a member or agent authorized to act for that group.

Review before prescribing

When a group-practice agreement was entered before a prescription that requires the agreement is issued, the prescribing practitioner must review the agreement immediately before issuing the prescription and update it if necessary.

Why this matters

The regulation prevents the agreement from becoming a static one-time form buried in a group practice’s chart. The individual prescriber remains responsible for reviewing the agreement at the point it matters.

Regulatory origin

The group-practice rule was adopted after the 2017 statute through Board of Pharmacy Regulation R047-18 and is now codified as NAC 639.838.
