State Board of Pharmacy role
The State Board of Pharmacy may adopt regulations necessary or convenient to enforce the pain-prescribing statutes and may impose additional requirements concerning Schedule II-IV controlled substances used to treat pain. The current Board President is Helen Park, and the current Executive Secretary is David Wuest.
Formal rule-petition route
NRS §233B.100 allows any interested person to petition a Nevada agency to adopt, amend, file, or repeal a regulation. The petition must be accompanied by relevant data, views, and arguments. Within 30 days, the agency must either deny the petition in writing with reasons or initiate regulation-making proceedings.
Important limit
A Board of Pharmacy rule petition can change implementing regulations such as NAC 639.838 only within the authority granted by statute. It cannot erase the statutory agreement mandate in NRS §639.23914.
