CONTRACT FOR CARE · RIGHTS, CONSENT & GOVERNMENT POWER

Our Legal Case

A patient’s need for medicine should not become the pressure used to obtain a criminal admission. Examine compulsory disclosures, penalties for silence, coerced rights waivers, and the circumstances behind the signature.

Use the original agreement and policy sources for this record to identify the exact clause, its legal source, and the stated consequence. Preserve those facts before reaching a conclusion about a particular provider or condition.

Apply the constitutional and consent review to this record
  1. Government responsibility: Which law, binding rule, agency instruction, or public-provider policy requires the particular disclosure or consequence? Separate it from provider-added terms.
  2. Potential criminal admission: Identify the exact spoken answer, written history, certification, or explanation and the real criminal risk it creates.
  3. Penalty for silence: Record what happens if the patient invokes the privilege or refuses a rights waiver, including denial, discharge, or interruption of treatment.
  4. Consent and pressure: Preserve the circumstances of signing, severity of pain, accessible alternatives, and whether the patient could honestly accept the prospective obligations.
  5. Criminal-use protection: Identify legally sufficient immunity and limits on use of both the answer and evidence derived from it. A privacy assurance is a separate protection.

Read the precedents, evidence framework, clause review, and remedies and reform demands. The work develops a proposed constitutional challenge; applying it to a particular condition requires its facts and legal authority.

Contract requested.

We have sourced office facts but have not obtained its current blank opioid agreement. That does not mean the office has no agreement. Any patient or practice can supply it for the record.

What Nevada requires

For covered pain prescribing of Schedule II–IV controlled substances intended to last more than 30 days, NRS639.23914 requires an agreement within 30 days after the initial prescription, recorded and updated every 365 days or when the plan changes. Its required subjects include goals, medically necessary testing consent, prescribed use, no sharing, specified disclosures, random pill-count authorization and reasons medication treatment may change or stop.

Section2(h) permits practitioners to impose additional requirements. Permission to add a condition does not make that condition a statewide requirement. Cancer, sickle-cell disease/variants, hospice and palliative care have statutory exceptions. Read the full state baseline and scope.

The hospital describes spine, sports and pain care and requires referral. Listing does not establish that opioids are prescribed. Site-stated clinicians include Emma Rickles MD, Casey Keating MD, Noel Blanco DO and Aaron Prado DO; independent licensure verification is pending.

What is still needed

The current blank agreement, revision/effective date, confirmation of which offices and patient groups use it, companion testing/payment/termination policies, and verified prescriber credentials. Public business facts are source-observed; overall licensure, ownership, appointment availability and opioid prescribing are not independently confirmed by this listing.

Evidence boundary: Publicly linked does not mean practice-confirmed current signed use. The condition comparisons are document summaries, not observed patient outcomes. “Added by the practice” means the reviewed agreement authority does not prescribe that specific condition; medical justification and enforceability are separate questions. No office is ranked and no illegality finding is made. Research/retrieval: October 13, 2026 UTC (October 12 Central).
