High-risk agreement trigger
If a patient is at high risk for medication abuse or has a history of substance abuse, the practitioner must use a written agreement between practitioner and patient.
Required agreement responsibilities
The agreement must address:
- Urine or serum medication-level screening when requested.
- Number and frequency of prescription refills.
- Reasons drug therapy may be discontinued, including agreement violation.
- A requirement that the patient receive prescriptions from one licensed practitioner and one pharmacy where possible.
Separate from the statewide chronic-pain rule
The Uniform Controlled Substances Act Regulations separately require a signed Treatment Agreement for covered chronic-pain patients generally. The Medical Board rule is a profession-specific pain-management standard that contains its own high-risk agreement trigger and specified responsibilities.

Section 18 of the Board’s rules remained in force through the Board’s 2025 regulatory updates. The Board also continues to require individualized treatment planning, informed consent, periodic review, consultation when needed, and complete medical records.
