The Wrong Layer
We Are Not Wrong… We Are Aiming at the Wrong Layer.
I want to begin by saying this clearly and without qualification:
The people I am speaking to are the advocates, organizers, lawyers, doctors, policy thinkers who are not naive. They are not lazy. They are not uninformed. Many of them understand policy mechanics, agency structures, statutory language, and regulatory pathways better than I ever will. Between them most people find blame among them… I no longer do.
This is not an argument about intelligence or effort.
It is an argument about which layer of the system we are engaging, and why so much good-faith advocacy continues to collide with invisible limits and immeasurable results.
Two Ways of Understanding “How the System Works”
Most modern advocacy operates within a procedural model:
Identify a harm.
Draft reform.
Pressure officials.
Change rules.
Enforce outcomes.
That model assumes:
Authority is aligned with responsibility
Officials can act if sufficiently convinced
Institutions respond primarily to evidence and moral clarity
That model is not wrong.
It is simply incomplete.
What I am working from is a structural model. One that asks why the procedures exist as they do, and why the people inside them so often feel unable to act even when they want to.
What Quietly Changed
Over decades and especially through crisis periods like the Great Depression, world wars, and moral panics… authority and responsibility were slowly separated.
Not through conspiracy.
Through emergency. Through executive order.
Temporary measures became permanent architecture.
Crisis logic became baseline logic.
Today:
Authority is displaced upward and outward
Responsibility remains local and personal
Discretion is treated as danger
Risk avoidance overrides judgment
Doctors still carry responsibility for patients, but lack discretion…
Legislators still carry responsibility to constituents, but lack authority…
Citizens still carry consequences, but lack agency….
Everyone feels trapped and everyone is told someone else is in charge.
The Old Deal: A Governing Posture, Not a Political Program
When I say Old Deal, I am not describing a party, a platform, or nostalgia for the past.
I am describing a governing posture that existed before emergency governance became permanent… A time when authority, responsibility, and proximity still traveled together.
Under the Old Deal:
Authority lived close to the people affected by it
Responsibility followed authority
Discretion was assumed, not feared
Officeholders were expected to decide, not defer

This was not a perfect system.
It was a human-scale system.
Mistakes were made… but they were owned by the people who made them not their neighbors.
Authority Was Local Because Consequences Were Local
In the Old Deal understanding, authority was not abstract.
If a decision harmed people, the decision-maker would: hear about it, face it, carry it
That proximity created both restraint and courage.
Modern governance has inverted this:
Decisions are abstracted
Authority is displaced
Responsibility remains personal
Risk flows downward
This inversion explains why so many good people feel trapped inside roles they thought meant something else.
Discretion Was Not a Loophole. It Was the Job
Today, discretion is treated as liability. Doctors are only as good as the law allows them to be.
Under the Old Deal, discretion was the entire point of holding office.
A doctor was trusted to weigh:
individual circumstances
benefit versus harm
lived reality versus theory
A legislator was trusted to weigh:
the letter of the law
the spirit of the law
the immediate needs of constituents
the long-term stability of the community
Removing discretion did not make the system safer.
It made it brittle.
What Politicians Expected And What They Found
Many modern state legislators entered office with Old Deal assumptions.
They believed they were inheriting:
meaningful authority
moral discretion
proximity to the people they represented
Instead, they found:
procedural constraints
federal preemption
regulatory capture
liability without authority
They adapted. They learned the rules. They complied.
But adaptation is not belief.
This is why so many officials privately say:
“There’s nothing we can really do.”
That sentence is not cynicism. It is evidence of structural displacement.
Why Progression Fails Under Stress
Modern policy culture assumes forward motion:
more regulation
more oversight
more abstraction
They call it progress…
That works only while systems are stable.
When systems destabilize… economically, politically, or militarily… people do not innovate forward.
They revert.
They revert to:
earlier frameworks
simpler authority chains
roles that feel legitimate
structures that once held under pressure
If those structures are not articulated before crisis, reversion looks like panic or extremism.
If they are articulated beforehand, reversion looks like wisdom. And here in lies the plan.
The Old Deal Is the Last Stable Layer
The Old Deal is not the past.
It is the last layer of governance where authority and responsibility were still aligned.
When modern systems shake and ours is about to, people instinctively search for that layer even though most often they cannot name it.
This is why: states assert themselves during federal failure
local officials act when national ones stall
communities trust proximity more than procedure
This instinct is not radical.
It is human.
Pain Patients Reveal the Failure First
People in chronic pain are not a special interest group.
They are early indicators of systemic failure. A canary in the coal mine.
Pain cannot be abstracted.
Pain cannot be deferred.
Pain cannot be spreadsheeted away.
They do label us Addict and Healthy but that’s neither here nor there. It’s simply a way to divide us.
The system that was built was built to avoid risk and will always sacrifice those whose suffering cannot be hidden or ignored. It’s the eugenics.
That is not ideology.
It is structural outcome.
It is history.
This Is Not an Attack
This is not an indictment of doctors, legislators, or advocates.
It is an explanation of how:
good people
acting in good faith
inside broken structures
produce inhumane results
Naming that is not blame.
It is clarity
What Reversion Actually Looks Like
Reversion is not revolution.
It looks like:
reclaiming discretion
restoring proximity
reuniting authority and responsibility
accepting and demanding self ownership again
Quietly.
Deliberately.
Without spectacle.
That is the Old Deal posture.
Why This Must Be Understood Before Crisis
Once collapse arrives, choices narrow.
Fear replaces thought.
Narratives harden.
Extremes rush in.
The purpose of articulating the Old Deal now is not to force action.
It is to leave a door open… So that when pressure comes, people know:
“There is another place to stand. Tried and True”
We do not need new ideals.
We need to remember where authority last made sense, and why it held.
The Old Deal is not nostalgia.
It is orientation.
And orientation is what allows people to act responsibly
when the ground begins to move and again it is most certainly about to start shaking…
This Matters.
Our current Deal is a system in which:
Legislators retain responsibility to constituents but lack meaningful authority
Doctors retain responsibility for patients but lack discretion
Citizens bear consequences while agency is displaced elsewhere
This condition produces paralysis, not malice.
The Old Deal has to be where we fall back as a people. Our job in all this is to represent it. To want our inheritance of American responsibility as individuals. Change is coming. We have two choices fall back to the Old Deal or be drug into a different deal more sontrolling than the one we have. which is just more of the same on extended credit. Credit that will run out.
History shows that when systems destabilize economically, politically, or militarily institutions do not innovate forward which will work in our favor. They revert to earlier, trusted frameworks which will work for us if we work it. If those frameworks are not clearly articulated before crisis though, reversion appears chaotic or extreme. If they are articulated in advance, reversion appears principled and stabilizing.
Our job is to be principled and stable representatives of what was.
People in chronic pain… Their suffering is not a special. Like all pain it is a warning signal of a system damaged if not broken.
This work is not an attack on institutions or individuals. It is an effort to clarify where authority last made sense, why it drifted, and what people will naturally reach for when procedural systems fail under pressure if we prepare people for change and condition them to find falling back to tried and true ways is an approved option. A desired avenue to explore.
The Old Deal is not a call to go backwards though it’s a call to move forward from a point of stability.
It is an orientation… a place to stand… when the ground begins to move. And it’s about to be shook on a biblical level. And in that shaking and trial is our opportunity for the change we so desperately need.
This is not something new. This is not radical. It is the Old Deal America once lived under when authority, responsibility, and proximity still belonged to the states and the people who elected them. The Charter is simply a reminder of what was already ours, written plainly so it can be claimed again by citizens, by doctors, and by state legislators who are willing to stand where their founders expected them to stand.
